Can Warner Brothers file an insurance claim regarding 'The Dark Knight's' Joker's (Heath Ledger's) death?

With Heath Ledger's untimely death, and since the movie was still in post production, can or will Warner Brothers file an insurance claim? Ledger's part of the filming was complete and most of the re-shoots involving him were already completed. Can they claim loss as his death TECHNICALLY caused the way they market and promote the film. He wasn't able to shoot specific marketing scenes and episodes for the various web sites that were planned. He wasn't able to re-record sound for editing and television broadcasts. He's not able to fulfill the appearances he was contractually obligated to do. Just curious.
